Privacy Notice
This document constitutes the Privacy Notice for the purposes of the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the “Law”), its Regulations, as well as the Privacy Notice Guidelines (hereinafter and jointly with the Law, the “Legislation”). Therefore, this Privacy Notice (hereinafter, the “Notice”) applies to the personal information collected about the Owner by Arrendadora Host SL, S.A. de C.V. (hereinafter “AHost”). For the purposes of this Notice, the terms used in this document with an initial capital letter and that are not defined therein will have the meaning attributed to them in the Legislation.
1. Identity and address of the Responsible Party
AHost, a company incorporated under the laws of the United Mexican States, with address at Calle Pedregal, number 25, Floor 3, Interior 300, Colonia Molino del Rey, Alcaldía Miguel Hidalgo, Postal Code 11040, in Mexico City, is responsible for obtaining, using, storing and disclosing the Personal Data of the Owners, in accordance with the provisions of this Notice, guaranteeing, as Responsible Party, the proper use, protection and confidentiality of the same, observing at all times the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility,
provided for in the Legislation.
2. Personal Data
In order to offer and provide you with the services and products that you request or contract with AHost related to the reservation of accommodations, payments, cancellations, modifications and reservations of excursions and food through the platform hosted on our website https://www.selina.mx (the “Site”), we will collect the following Personal Data from you: identification and contact data.
Additionally, AHost may collect Sensitive Data such as gender, electronic data (IP address, type and version of your browser, information on the devices that access the Site, connection data, information and parameters regarding the search engines and applications that you have downloaded). The purpose of collecting and processing Sensitive Data is so that AHost can verify and validate your identity, prevent fraud and evaluate the request for contracting that you make for our Services (as said term is defined below) and/or issue a decision regarding said request, and to comply with applicable legal provisions in other matters.
In this regard, in strict compliance with the provisions of the Legislation, in this act you expressly consent to the processing of Sensitive Data by AHost.
It is important to mention that with the exception of the Sensitive Data listed above, the previously mentioned items are categories of Personal Data. In the event that you require to know each of the Personal Data that is collected, please contact AHost through the means indicated in this Notice. The Personal Data that we may request from you and that is collected will be treated under the strictest physical, technical and administrative security measures that guarantee its protection and confidentiality, once your Consent is obtained.
Personal Data may be accessed through the Site, or by any other electronic, telephone, video, or other technology means (the “Electronic Media”), including Landing Pages, hyperlinks, specific subsections for certain products offered by AHost or Plug-ins within the Site and, where applicable, through agents, promoters, commissioners, suppliers or business partners, including without limitation when the Owner: (i) registers to use any of the services available on the Site, including Landing Pages, hyperlinks or Plug-ins within the Site; (ii) uses the Site; (iii) sends questions, queries or comments or contacts the Site;
(iv) requests information or materials; and/or (v) provides information to the Site in any way (such as chats, forums, uploads).
3. Purposes
AHost will use your data for the following primary purposes:

To contact you to provide you with information about our accommodation reservation services, modifications to said reservations, cancellations, follow-up on reservations and excursion reservations, registering for membership programs (the “Services”);

To identify and validate the identity of the person who requests information regarding any of the Services and/or contracts or acquires any of them as actions to prevent fraud and identity theft;

To manage, operate and follow up on the Services and products that you request or contract with AHost and comply with your personal preferences;

To generate files for the follow-up of clients and suppliers in our database, directly or through a third party;

To process, evaluate and respond to the requests that you make through the Site;

To verify the accuracy and veracity of your Personal Data in order to offer an individualized version of our Services and commercial offer according to your needs, preferences;

Inform about changes or new products or Services that are related to the contracted service;

Comply with regulatory obligations contained in the Legislation and/or any other applicable legal system, as well as those obligations contracted with our current or potential clients, as well as with our suppliers and business partners;

Evaluate the quality of our service;

The promotion of products, services, additional benefits, discounts, promotions, bonuses, contests, market studies, raffles and advertising in general;

Respond to queries, claims or complaints raised by the Holders about the products and Services provided;

Prepare studies for research and statistical purposes;

Work with third parties, including the collection of publicly used information from social event websites, to help us better understand your interests and provide a more personalized service;
Additionally, AHost will use your Personal Data for the following secondary purposes, which are not necessary for the provision of our Services, but which allow us and facilitate providing you with better service and which may be of interest to you and improve your experience as a user (current or potential) of the AHost Services:
Sending newsletters, communications, and general information for marketing, promotion, advertising and/or commercial prospecting purposes.
Informing about new products or services.
Carrying out business intelligence, conducting market research, giving visibility to your activity on the Site, monitoring the quality of the Site, evaluating and improving the Site and sending our newsletter and offers. Sending and receiving communications through the Site in relation to our Services.
If you, the Owner, do not wish your Personal Data to be processed for secondary purposes, you may, at any time, object to the processing for such purposes by exercising your right to object in accordance with this Notice. For these purposes, you can submit a written statement stating the above from now on by emailing danielr@vonda.mx.
4. Remissions and Transfers of Personal Data
AHost informs you that it may make Remissions (communication of data between AHost and third parties acting as Managers, who may or may not be subsidiaries or affiliates of AHost) regarding some or all of your Personal Data, within and outside the country and that, in terms of article 53 of the Regulation of the Law and other applicable Legislation, your consent will NOT be required.
Likewise, you are informed that for the correct provision of our Services we may require the intervention of companies outside of AHost, whose intervention is necessary in some phase of the provision of the Services, including data analysis companies and identification of the behavior of our users, verification of technical failures, customer service, cloud communications, information storage and data encryption, CRMs and payment processors.
It is important to mention that the companies mentioned above as an example are recipients of your Personal Data only under the figure of the Data Processor, which, in accordance with section IX of article 3 of the Law, is defined as “the natural or legal person who alone or jointly with others processes Personal Data on behalf of the Controller”, with the Controller being understood as “the private natural or legal person who decides on the processing of personal data”. In this sense, such third parties may only process your Personal Data in accordance with the instructions that AHost (as the Controller) expressly provides them and/or in accordance with the legal relationship they have with AHost, but they do not have the authority and/or decision-making power to autonomously and independently determine the processing to which your Personal Data will be subjected.
5. ARCO Rights
You, the Owner, are the owner of your Personal Data, therefore, at all times you will have the right to:
Access your Personal Data that we possess and process;
Rectify them if they are inaccurate or incomplete;
Cancel them when you consider that they are excessive or unnecessary for the purposes that justified their collection and processing, there is improper use of them by us and/or the purposes that gave rise to their collection and processing have ceased to exist; and/or
Oppose the processing of them for specific purposes or secondary purposes (provided that there is a legitimate cause for such purposes and that the processing is not strictly necessary for the fulfillment of any obligation derived from the legal relationship created between you and us).
These rights over your Personal Data referred to in the Legislation as ARCO rights, can be exercised at any time through the following free means:
(I) . By sending an email to the email address danielr@vonda.mx; and/or
(II). In writing with acknowledgement of receipt, at our address located at Calle Pedregal, number 25, Floor 3, Interior 300, Colonia Molino del Rey, Alcaldía Miguel Hidalgo, Postal Code 11040, in Mexico City.
Your request to exercise your ARCO rights must contain:
Full name of the Holder, address or other means to communicate the response to your request;
Documents that prove your identity or, where appropriate, the legal representation of the Holder (voter ID or passport);
Clear and precise description of the Personal Data for which you seek to exercise any of the ARCO rights; and
Any other element or document that facilitates the location of the Personal Data. In the case of requests for rectification of Personal Data, the Holder must also indicate the modifications to be made and provide the documentation that supports his/her request.
Once the request has been received with all the above requirements, AHost will have a maximum period of 20 (twenty) business days to notify the Holder of the decision adopted, so that, if appropriate, it will be made effective within 15 (fifteen) days following the date on which the response is communicated. The aforementioned deadlines may be extended once for an equal period, provided that the circumstances of the case justify it, in accordance with the provisions of the Legislation.
The aforementioned deadlines for the presentation, attention and response to requests to exercise your ARCO rights will begin to be computed on the same day that we have received your request, provided that it is within our business hours, which are from 9:00 a.m. to 6:00 p.m. from Monday to Friday (excluding official non-working days).
In the event that the information provided in the request is insufficient or erroneous, or the necessary documents are not included, AHost may, within 5 (five) business days following its receipt, require the Holder to provide the elements or documents necessary to process it, the latter having a period of 10 (ten) business days to respond to the request, which will begin to run from the day after the request was received; if no response is given within said period, the corresponding request will be deemed not submitted, without liability for AHost, however, the Holder may resubmit the request at any time. AHost's response will be given by the means you indicate in the respective request.
6. Revocation
The Owner may revoke the consent granted to AHost for the processing of his/her Personal Data at any time, without retroactive effect, in those cases in which said revocation does not imply the impossibility of fulfilling obligations derived from a legal relationship in force between the Owner and AHost. The Owner is aware that, for certain purposes, if the revocation of his/her consent were to be appropriate, this could imply that AHost cannot continue to provide the service for which it was contracted or, failing that, the conclusion of the existing relationship between the parties. The procedure for the revocation of consent, if applicable, will be the same as that established in the previous section for the exercise of ARCO rights.
7. Security Measures and Limitation of the Use or Disclosure of Personal Data
AHost has implemented strict physical, technical and administrative security measures for the proper protection of your Personal Data, so that they remain confidential and to prevent unauthorized access, use or processing of them, as well as possible damage, loss or alterations at any stage of the provision of our Services.
AHost will use your Personal Data in strict compliance with the purposes set forth in this Notice and for as long as necessary in accordance with the applicable legal provisions.
Likewise, AHost makes available to you the following email address danielr@vonda.mx so that the Owner can at any time express his or her refusal to continue receiving communications or promotions from us from the account in which he or she receives said communications or promotions, as well as adhere to our exclusion list, which aims to record your refusal to the processing of your Personal Data for marketing and advertising purposes. The Owner may also exercise his or her right to limit the use or disclosure of his or her Personal Data, for example, for marketing and/or advertising purposes, following the same procedure as with ARCO rights.
8. Cookies and Other Technologies
The Site uses cookies, which are data files that are stored on the hard drive of a user's computer or electronic communications device when browsing a specific website, which allows the exchange of status information between said site and the user's browser. Status information may reveal means of session identification, authentication or user preferences, as well as any data stored by the browser regarding the website. If you wish to know the procedure to disable cookies, please consult the "Help" section of your Internet browser.
Through cookies, AHost measures information about users who visit the Site, collects data about the operating system, time, browser and the medium with which they access the Site. Likewise, AHost collects the average browsing time and statistics of the most visited sections. AHost obtains the aforementioned data in order to understand the behavior of the Owners, profile and adapt marketing campaigns.
If you do not wish to do so, you can configure your browser to accept, manage or reject all or some cookies, as well as delete those downloaded or installed on your device. However, it is possible that some of its technical and functional features are not provided or displayed properly and, therefore, your browsing experience within the Site may be less satisfactory.
The Site may contain links to and from other Internet sites other than ours. AHost is not responsible for the privacy practices or the treatment of Personal Data of those sites. AHost recommends that you consult the privacy practices of said Internet sites before using them.
9. Modifications to the Privacy Notice
This Notice may be subject to modifications or updates as a result of regulatory changes; our own needs for the products or Services we offer; privacy practices; changes in our business model, or for other reasons. Changes and updates to this Notice will be made known to you on our Site or through any means of communication with the Owner, notifying the changes and/or updates to this Notice. Once the change(s) to the Notice are published, they will come into effect the day after their publication, in the media referred to above. The Owner will have 5 (five) days from publication on the Site to state whether he/she is not in agreement with the modifications, in which case, AHost may cease providing the Services. After this period has expired without any objection from the Owner, it will be considered that he/she accepts the modifications to the Notice.
Likewise, you can contact us at any time through the indicated means, to answer any questions, clarifications or suggestions regarding your Personal Data.
10. Right to information of the Holders and competent Regulatory Authority
If you consider that your right to the protection of your Personal Data has been violated by any conduct of our employees or our actions or responses, you can contact us through the indicated means, without prejudice to the right to go to the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI), which is the authority in Mexico that guarantees the right to the protection of Personal Data held by individuals.
11. Consent
By using the Electronic Media and/or requesting or contracting our Services, and by providing us, by any means, your Personal Data, you, as the Owner of the same, expressly acknowledge and accept this Notice, so that said consent grants us the power to proceed with the processing of your Personal Data in the manner indicated in this Notice and in strict compliance with the Legislation, without prejudice to the rights conferred to you by the Legislation.
Likewise, as the Owner of the Personal Data, you declare that you have read this Notice, that you know the categories of Personal Data collected (including the categories relating to financial and property data, and any other category or Personal Data that require your express consent), as well as the purposes for which they will be processed; and that you freely consent to the processing of your Personal Data in the terms described.
